Austria to challenge taxonomy in EU court

(EurActiv, 7 Jul 2022) Austria reacted fiercely after the European Parliament voted in favour of labelling nuclear and gas projects as green investments and said it would sue the EU over the controversial decision.

Austria already announced in November that it would take legal action if the taxonomy included nuclear energy and renewed this pledge after the European Parliament failed to gather a majority to oppose the delegated act.

“We have already prepared ourselves intensively for this case in recent weeks and months and will file our lawsuit within the deadline set for this,” Climate Minister Leonore Gewessler said in a statement. Gewessler called the decision an act of “greenwashing” and stressed that it does not do justice to the ambitions of the Green Deal.

“It is neither credible, ambitious, nor knowledge-based, endangers our future and is more than irresponsible,” she stressed.

Luxembourg already announced they would support the Austrian push. “We will consider further legal steps together with Austria,” Luxembourgish Energy Minister Claude Turmes tweeted.

Spain and Denmark announced ahead of the vote that they would also consider joining the lawsuit. Germany, however, who initially said that they would “examine” the option of a lawsuit, ultimately decided not to follow suit.
